2013 JBoss Community Recognition Awards - Terms and Conditions

OFFICIAL RULES

NO PURCHASE NECESSARY TO ENTER OR WIN. VOID WHERE PROHIBITED.

1. CONTEST DESCRIPTION
Red Hat, Inc. is sponsoring the JBoss Community Recognition Awards ("Awards Contest"), a skill contest in which invited individuals who have contributed to JBoss.org Community Projects may nominate fellow JBoss.org contributors for a chance to receive an award.

2. ELIGIBILITY
To be eligible to nominate a contributor, the “Nominator” must be: (1) an existing JBoss Community contributor (defined as a person who has signed the JBoss Contributor Agreement); (2) invited by an email from Rayme Jernigan to make such a nomination; and (3) above the age of majority in the jurisdiction of legal residence at the time of entry. Nominators must have access to the Internet and a valid email address, at the date of entry, to enter the Awards Contest. Employees, officers, and directors of Sponsor, its subsidiaries and affiliated companies, and their immediate families and those living in their households are not eligible to enter. Government employees are not eligible to enter.

If you are entering as part of a company or on behalf of your employer, these rules are binding on you, individually, and/or your employer. If you are acting within the scope of your employment, as an employee, contractor, or agent of another party, you warrant that such party has full knowledge of your actions and has consented thereto, including your potential receipt of a prize. You further warrant that you and your employer have no claim to or right of ownership in any work product created as part of the Contest and that your actions do not violate your employer's or company's policies and procedures.

3. ENTRY PERIOD
Nominations must be submitted between 12:00 Eastern Time (“ET”) and 5:00 pm. ET on May 22nd, 2013 (“Nomination Period”).

4. HOW TO NOMINATE
To make a nomination in the Awards Contest, Nominator must reply to the email from Rayme Jernigan during the Nomination Period. The reply email must identify the nominee, explain why the Nominator believes nominee deserves to be recognized, and explain what the nominee (“Nominee”) contreding 2012 (“Submission”).

In addition, the Submission must:

  • Specify the category in which the Nominee is being nominated:
  1. Bug Fixes
  2. New Features
  3. Documentation
  4. Wiki
  5. Issue/Jira
  6. Community Leadership
  • Be 250 words or less
  • Be original and written solely by the Nominator
  • Not contain libelous, disparaging, defamatory, obscene or otherwise objectionable content
  • Be written in English

Nominators are not required to nominate an individual in each category, but Nominator may nominate only one (1) person in each category. Nominees are eligible to be entered into multiple categories. The Nominator must receive email confirmation from the Nominee that (s)he has the permission of the Nominee to use the Nominee's name and identifying information in the Submission, that Nominee accepts the nomination for a chance to win the wards Contest, and that the Nominee agrees to be bound by these Official Rules. If Nominee refuses to accept nomination for Awards Contest, such nomination Submission is void.

Sponsor reserves the right to edit the Submissions for clarity. All Submissions become the property of Sponsor and will not be returned or acknowledged. Submissions are void if they are in whole or part illegible, incomplete, damaged, altered, counterfeit, manipulatedobtained through flost, late, misdited, or m, or for any computer related, online, telephonic, or technical malfunctions that may occur whether or not within Sponsor's control. Sponsor reserves the right, in its sole discretion, to disqualify any Submission not in compliance with these Official Rules.

5. SPONSOR

Red Hat, Inc., located at East Davie Street, Raleigrth Carolina 27601, USA, is the sponsor of the Awards Contest ("Sponsor").

6. JUDGING

Between June 20th at 12:00 pm ET and July 26th, 2013 at 5:00 pm. ET ("Voting Period"), members of the JBosg community may visit http://www.jboss.org/jbcra/vote ("Voting Site") and vote for the Nominee in each category that (s)he believes deserves to be recognized as a "JBoss Community Leader." Voters should review all Submissions and vote for a Nominee based on:

  1. The difficulty of the problem to be solved;
  2. The degree of skill required for the described work; and
  3. The elegance of the solution to the problem.

LIMIT – EACH VOTER MAY ONLY CAST ONE (1) VOTE PER CATEGORY. Any subsequent votes submitted by a voter will be disqualified.

The Nominee who receives the most votes in the category or categories in which he or she is nominated will receive the “JBoss Community Leader” title in that category. In the event of a tie, each of the tying Nominees will receive the "JBoss Community Leader" title in that category. The names of those awarded the title of “JBoss Community Leader” will be posted on the JBoss.org website. Sponsor's decision is final with respect to all aspects of the Awards Contest.

7. AWARD

Each Nominee will receive one (1) event T-shirt with an Approximate Retail Value (“ARV”) of $10 USD.

Each JBoss Community Leader will receive an “Award” consisting of one (1) T-shirt of a different design and one (1) trophy recognizing his or her achievement. The ARV of the Award is approximately $50 USD. Provided they are able to attend, JBoss Community Leaders will also be recognized at JUDCon2013:UnitedStates, a JBoss developer event in Boston. Award is not redeemable for cash. No substitution, cash substitution, or assignment or transfer of the awards is permitted, except by Sponsor for reason of unavailability, in which case a Gift of equal or greater value will be awarded. All taxes, costs, and fees associated with the Gifts are the sole responsibility of the winners. The Award consists of only those items specifically listed as part of the Award. Awards are provided without warranty of any kind from Sponsor, express or implied, without limitation, except where this would be contrary to federal, state, provincial, or local laws or regulations. Odds of winning depend on the number of eligible submissions received and the skill of the Nominees.

8. CONDITION OF PARTICIPATION

By submitting a Submission (Nominator) or providing your acceptance to Sponsor of a nomination on your behalf (Nominee), you: (i) agree to be bound by these Official Rules; (ii) confirm that you meet all eligibility requirements listed herein; (iii) warrant and represent that you are the sole author and creator of the Submission, that your Submission does not violate any applicable law, and that you have no reason to believe that your Submission infringeviolates any intellectual property right held by any third person; (iv) agree that all federal, state, provincial and local laws and regulat apply; and (v) agree that theficial Rules and the decisions of Sponsor are final and binding on all matters peng to this Awards Contest. To the extent permitted by law, all participants in the Awards Contest agree to hold Sponsor, its respective directors, officers, employees and assigns harmless for any injury or damage caused or claimed to be caused by participation in the Awards Contest and/or use or acceptance of the award. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Awards Contest, or in the announcement of the winner.

If, in Sponsors' opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Awards Contest, including the voting process, or if technical difficulties compromise the integrity of the Awards Contest, the Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Awards Contest. Any attempt to deliberately damage the content or operation of this Awards Contest is unlawful and subject to legal action by Sponsor or its agents. You may be prohibited from participating in this Awards Contest if Sponsor, in its sole discretion, reasonably believes that you have attempted to undermine the legitimate operation of the Awards Contest by cheating, deception, or other unfair playing practices, or nn, reatened, or harassed any other participants, Sponsor, or associated agencies.

Participants will be asked to provide personal information to enter the s Contest, which will be transferred to servers located in the U.S. By enteAwards Contest, you consent to transfer of your personal information and to the terms of the Sponsor’s privacy policy located at www.redhat.com/legal/privacy_statement.html. If you wish to opt out of receiving further communications from Sponsor or have other questions regarding Sponsor’s privacy policy, please contact Sponsor East Davie Street, Raleigh, NC 27601, Attn: JBCRA.

9. LICENSE

As a condition of participation, Nominators and Nominees grant Sponsor and its licensees an irrevocable, worldwide, royalty-free, and non-exclusive license, for the duration of protection of the rights, to use, reproduce, distribute, translate, publicly perform, publicly display and create a derivative work from the Submission. Nominators and Nominees agree to allow Red Hat to publish his or her name in association with the Submission and in association with all advertising and marketing of or related to the Awards Contest. Furthermore, Nominators warrant that they received permission from the Nominee to include the Nominee's name and personal information in the Submission. Nominators who are residents of PRC grant Sponsor the right to make their submission public. All participants agree to execute any further documents as necessary to effect the preceding license.

10. RELEASE OF LIABILITY

By participating, participants and winners release Sponsor, its affiliates, parent, and subsidiary companies, its employees, agents and officers, advertising and promotion agencies, licensees, as well as all others associated with the development and execution of this Awards Contest, from and against any and all liability with respect to or in any way arising from the Awards Contest and the awarding and use of the awards, or in connection with the use, modification, or publication of the Submission. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; or theft, destruction of, alteration or unauthorized access to Awards Contest submissions.

11. GOVERNING LAW

This Awards Contest is subject to all federal, state, and local laws. This Awards Contest and Official Rules are governed and interpreted by the laws of the State of North Carolina, without regard to its conflict of law provisions.

Sponsor will post the Official Rules at http://www.jboss.org/jbcra/terms and names of the winners online at http://www.jboss.org/jbcra/.
