JBoss Community Recognition Awards

OFFICIAL TERMS

NO PURCHASE NECESSARY. VOID WHERE PROHIBITED.

JBoss, a division of Red Hat, is sponsoring the JBoss Community Recognition Awards ("Awards Program"), a program allowing select persons who have contributed code to JBoss to nominate fellow code contributors to receive the awards described below. Nominations must be submitted no later than 5 p.m. Eastern Standard Time ("EST") on December 19, 2008 ("Nomination Deadline").

1. Eligibility
To be eligible to nominate a code contributor, the "Nominator" must be: (1) an existing JBoss code contributor, as defined by signatories of the JBoss code contribution, who is invited by email from Axel Kandel to make such a nomination; and (2) above the age of majority in his or her country, province, and/or state of legal residence at the time of participation.
2. How to Nominate
Nominators may nominate other code contributors ("Nominees") to receive the award described below. To make a nomination in the Awards Program, Nominator must first receive an email from the Project Lead and reply to that email prior to the Nomination Deadline. The reply email must explain why the Nominator believes the Nominee deserves to be recognized, and explain what the Nominee contributed during 2008. In addition, the submission should meet the following requirements:
  1. (a) It should be less than 500 words;
  2. (b) It must be original and written solely by the Nominator;
  3. (c) It should not contain libelous, disparaging, defamatory, obscene or otherwise objectionable content;
  4. (d) It should be written in English;

Furthermore, the Nominator must ensure (s)he has the permission of the Nominee to use the Nominee's name and identifying information in the nomination. LIMIT ONE (1) NOMINATION PER PERSON.

All submissions become the property of JBoss and will not be returned or acknowledged. Submissions are void if they are in whole or part illegible, incomplete, damaged, altered, counterfeit, manipulated or obtained through fraud or lost, late, misdirected, mutilated, incomplete, or illegible submissions or email, or for any computer related, online, telephonic, or technical malfunctions that may occur whether or not within JBoss's control.

3. Sponsor

JBoss, a division of Red Hat, located at 3340 Peachtree Road, NE, Suite 1200, Atlanta, Georgia, USA, is the sponsor of the Awards Program ("Sponsor" or "JBoss").

4. Evaluation of Submissions

Voting will take place at JBoss.org ("Voting Site").

5. Voting Process

Between March 20th, 2009 and April 17th, 2009 ("Voting Period"), those who wish to vote may visit the Voting Site to review all nominations and vote for the Nominee they feel deserves the award. and recognition described below. YOU MAY ONLY VOTE ONCE DURING THE VOTING PERIOD.

The Nominee who receives the most votes will be selected to receive the award. In the event of a tie, each of the tying nominees will share the "JBoss Community Leader" title in the nominated category for the coming year. The potential winner will be notified by e-mail that (s)he had the most votes in the Awards Program on or about April 21st, 2009. The potential winner will be announced on the JBoss.org website. If the e-mail notification is returned as undeliverable or ignored, then that potential winner will be disqualified, and the person who had the next highest number of votes will be selected to receive the award. JBoss's decision is final with respect to all aspects of the Awards Program.

6. Gifts

On April 28th, 2009, Sponsor will award one (1) Nominee a plaque and an event t-shirt. Approximate Retail Value of awards: $50. The ARV may be adjusted depending on the country of residence of the winner.

No substitution, cash substitution, or assignment or transfer of the awards are permitted, except by Sponsor for reason of unavailability, in which case a award of equal or greater value will be awarded. All taxes, costs, and fees associated with the awards are the sole responsibility of the winners. Odds of winning depend on the number of eligible submissions received.

7. Condition of Participation

By submitting a nomination, you agree to be bound by these Official Terms and you confirm that you meet all eligibility requirements listed herein. You agree that all federal, state, provincial and local laws and regulations apply. By registering for the Awards Program, you agree that these Official Terms and the decisions of Sponsor are final and binding on all matters pertaining to this Awards Program.

Acceptance of the award constitutes permission for, and winners consent to, Sponsor and its agencies to use the Nominee's name and/or likeness for advertising and promotional purposes, in any media now known or hereafter devised, without further notice, compensation, consideration, review, or consent, and without regard to moral rights, unless prohibited by law.

To the extent permitted by law, all participants in the Awards Program agree to hold Sponsor, its respective directors, officers, employees and assigns harmless for any injury or damage caused or claimed to be caused by participation in the Awards Program and/or use or acceptance of the award. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Awards Program, or in the announcement of the winner.

If, in Sponsors' opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Awards Program, including the voting process, or if technical difficulties compromise the integrity of the Awards Program, the Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Awards Program. Any attempt to deliberately damage the content or operation of this Awards Program is unlawful and subject to legal action by Sponsor or its agents. You may be prohibited from participating in this Awards Program if Sponsor, in its sole discretion, reasonably believes that you have attempted to undermine the legitimate operation of the Awards Program by cheating, deception, or other unfair playing practices, or annoys, abuses, threatens, or harasses any other participants, Sponsor, or associated agencies.

8. License

As a condition of participation, Nominators grant Sponsor and its licensees an irrevocable, worldwide, royalty-free, and non-exclusive license, for the duration of protection of the rights, to use, reproduce, distribute, translate, publicly perform, publicly display and create a derivative work from the submission that participant submits when making a nomination in the Awards Program. Nominators also agree to allow JBoss and Red Hat to publish his or her name in correlation with the submission and in correlation with all advertising and marketing of or related to the Awards Program. Furthermore, Nominators warrant that they received permission from the Nominee to include the Nominee's name and personal information in the submission. Further, Nominator's who are residents of PRC grant Sponsor the right to make their submission public. All participants agree to execute any further documents as necessary to effect the preceding license.

9. Release of Liability

By participating, participants and winners release Sponsor, its affiliates, parent, and subsidiary companies, its employees, agents and officers, advertising and promotion agencies, licensees, as well as all others associated with the development and execution of this Awards Program, from and against any and all liability with respect to or in any way arising from the Awards Program and the awarding and use of the awards, or in connection with the use, modification, or publication of the essay submitted by the Nominator. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; or theft, destruction of, alteration or unauthorized access to Awards Program submissions.

10. Governing Law:

This Awards Program is subject to all federal, state, and local laws. This Awards Program and Official Terms are governed and interpreted by the laws of the State of North Carolina, without regard to its conflict of law provisions.
